We are thrilled to have you join us for a unique experience of enjoying coffee and spending time with our resident cats. Before you enter, we kindly ask you to read and agree to the terms outlined in this Waiver and Release Form.

 

 

Visitor Acknowledgment and Acceptance of Risks

 

Interactions with Cats:

I understand that while all cats at Catfé are health-checked and socialized, interacting with animals inherently involves risks of injury or illness to humans, including but not limited to scratches, bites, allergies, or communicable diseases. I assume full responsibility for any personal injuries, illnesses, or health conditions that may occur during my visit, including potential exposure to COVID-19 or other infectious diseases, despite Catfé’s health and safety protocols.

 

Medical Emergencies:

In the event of an accident or medical emergency, I authorize Catfé staff to seek medical assistance as deemed necessary. I accept full responsibility for any resulting medical costs.

 

Personal Belongings:

I acknowledge that Catfé is not responsible for any loss, theft, or damage to personal belongings brought into the café.

 

Food and Beverage Consumption:

I acknowledge that Catfé may partner with independent, third-party food and beverage providers to enhance my experience. I understand that Catfé does not produce or prepare these food and beverage items and makes no representations regarding their ingredients, preparation methods, or potential allergens. I assume full responsibility for any allergic reactions, foodborne illnesses, or other issues arising from the consumption of food or beverages from these third-party providers. I agree to communicate any dietary restrictions or allergies directly to the vendor at the time of purchase. Catfé expressly disclaims liability for any harm resulting from the negligence or actions of third-party vendors.

 

Compliance with Rules and Behavior Expectations:

I agree to abide by all Catfé rules and instructions provided by staff regarding the safe and respectful interaction with the cats and the use of the café’s facilities. I agree to treat all animals with respect and care. I understand that any behavior deemed aggressive, disruptive, or harmful toward the cats, staff, or other patrons may result in my immediate removal from the premises without a refund.

 

Non-Refundable Payments:

I acknowledge that all payments made for entry or activities at Catfé are non-refundable, including if my visit is terminated due to non-compliance with Catfé policies.

 

 

Release and Waiver of Liability

 

By signing this form, I release Catfé, its owners, employees, partners, volunteers, and affiliates from any claims, demands, losses, liabilities, damages, or expenses incurred during my visit, except in cases of gross negligence or willful misconduct by Catfé.

 

I understand that participation in activities at Catfé is not continuously supervised, and staff may not be present during the entirety of my interaction with the cats. However, Catfé staff will be available to offer assistance and ensure a safe environment for all participants.

 

I affirm that I have no known physical or emotional conditions, including allergies to cats, that would impair my ability to engage safely in these activities.

 

I agree not to engage in any behavior that could harm the cats or other participants.

 

This Release shall be binding on my heirs, executors, administrators, and assigns and shall be governed by the laws of Santa Clarita, CA. Any disputes arising under this Release shall be adjudicated exclusively in the courts of Santa Clarita, CA.

 

 

Minor Participant Consent

 

If the participant is under eighteen (18) years of age, a parent or legal guardian must read and agree to the terms of this Waiver, Release, Hold Harmless, and Indemnification Agreement on behalf of the minor.

 

Parent/Guardian Acknowledgment and Consent for Minor:

I understand that as the parent or legal guardian, I am responsible for the safety, behavior, and actions of the minor(s) under my care while participating in activities at Catfé. A maximum of two (2) minors is allowed for every one (1) adult present. By checking this box and submitting this waiver, I agree to abide by this policy and confirm that I will be present with the minor(s) at all times during our visit to Catfé. I accept full responsibility for any actions, damages, or injuries caused by the minor(s) under my care.

 

I certify that I am the parent or legal guardian of the minor participant named below. I have read and understand the contents of this Agreement, including the Photo and Video Release Consent. By selecting the “Sign Waiver” button, I consent to the terms of this Agreement on behalf of the minor and agree that both the minor and I shall be bound by its terms.

 

 

Photo and Video Release Consent

 

By signing this Release, I grant Catfé and its legal representatives, successors, and assigns the irrevocable right and permission to photograph or otherwise record me during my visit to the premises, and to use said photographs and recordings for any lawful purpose, including but not limited to promotional materials, social media, and other publications, without compensation or acknowledgment.

 

I waive any right to inspect or approve the finished product or the advertising copy used in connection with an image or recording. I release Catfé and its representatives from any claims related to the use of my image or likeness, including claims of defamation or invasion of privacy.

 

This consent extends to photos and video recordings created by Catfé, as well as any media submitted by me to Catfé for promotional use, such as customer testimonials or user-generated content shared on social media platforms.

 

 

Acknowledgment of Understanding

 

I have read this waiver and release form and fully understand its terms. I acknowledge that I am signing it freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

 

 

Electronic Signature Consent

 

By selecting the “Sign Waiver” button below, I acknowledge and agree that this action constitutes my electronic signature and signifies my intent to be bound by the terms of this Waiver, Release, Hold Harmless, and Indemnification Agreement, including the Photo and Video Release Consent. I understand and agree that my electronic signature is legally binding, just as if I had signed a physical document. I confirm that I have read and fully understand the contents of this Agreement before agreeing electronically.
